The publishers of the MM templates will shortly release a number of changes to the template packs for subscribers of the MM Templates.

Eligibility Assessment & Notification Templates

There are now two new sets of engagement documents available for use in the Other Pack.

Eligibility Assessment

The ‘Eligibility Assessment’ subfolder contains an engagement contract and letter suitable to be used for initial eligibility assessments, for example where an initial assessment of a client’s eligibility for a skilled or work visa is required.

These templates have been created using the following Category/Matter Type:

  • Category: Visa Eligibility Assessment
  • Matter Type: Initial Assessment

Suggested stream names for this Matter Type include:

  • employer sponsored
  • skilled
  • skilled or employer sponsored
  • subclass 491 – Skilled Work Regional (Provisional)
  • subclass 494 – Skilled Employer Sponsored Regional (Provisional)

Notification

The ‘Notification’ subfolder contains abbreviated versions of the standard engagement contract and letter, to reflect the simple process required when notifying the Department of a visa holder’s change of passport, address or name.

These templates have been created using the following Category/Matter Type:

  • Category: Other
  • Matter Type: Notification

Suggested streams for this Matter Type include:

  • change of address
  • change of name
  • new passport

NOTES:

  • The stream names suggested above reflect common scenarios for these matter types. You may choose to add alternative/additional streams to reflect the needs of your practice.
  • To ensure that this information merges accurately in the relevant templates, we recommend that you use lower case letters in the stream names (unless required by subclass names, as demonstrated in the above examples for the Eligibility Assessment templates).
  • Do not include the word ‘visa’ in the stream name, as this will result in duplication of this word in the templates.
  • The wording of these templates is predicated upon the payment of a single professional fee upon signing the agreement. Should you use a different approach, you will need to adjust the templates accordingly.
  • We recommend that standard fees and time estimates be entered in the Fee Schedule for all streams created for these matter types, to ensure that the templates merge correctly.
  • In each case, suggested wording has been provided for the timeframe and nature of service on p2 of the agreement, with additional notes/guidelines provided in red type. This wording must be adjusted to reflect your preference.

AAT Engagement Documents

The Administrative Appeals Tribunal (AAT) engagement documents (Appeals Pack, AAT folder, B. Engagement) have been divided into two subfolders:

  1. NOM & VISA REFUSAL: these templates are to be used where the application under review is a type that requires nomination, and you are acting as the authorised representative for both the nomination and visa review applications. These templates address two scenarios:
  • Where you are acting for your client through all stages of the review process (application lodgement, preparation of submissions and attendance of scheduled hearing). These templates have the suffix ‘All Stages’;
  • Where you start acting for your client AFTER the review applications have been lodged (e.g. by another agent, or by your client), and you prepare the submissions/attend the scheduled hearing. These templates have the suffix ‘Subs & Hearing’.
  1. VISA REFUSAL OR CANCELLATION: these templates are to be used where you are acting as the authorised representative for the visa review application only, whether for a visa refusal or cancellation. These templates address two scenarios:
  • Where you are acting for your client through all stages of the review process (application lodgement, preparation of submissions and attendance of scheduled hearing). These templates have the suffix ‘All Stages’;
  • Where you start acting for your client AFTER the review application has been lodged (e.g. by another agent, or by your client), and you prepare the submissions/attend the scheduled hearing. These have the suffix ‘Subs & Hearing’.

These templates have been created using the following Category/Matter Types:

  • Category: Appeal
  • Matter Type: AAT- Nomination and Visa Refusals/AAT – Visa cancellation/AAT – Visa refusal

To allow these templates to merge accurately, we recommend that you create the following streams for the Matter Types listed above

  • Lodgement, Submissions & Hearing
  • Submissions & Hearing

NOTES:

  • The wording of these templates is predicated upon the use of merge fields for the blocks of work required at each stage of the service. These merge fields describe the stage of work required, together with the attendant fee. Additional instructions and suggested block descriptions are provided in red type in clause B.1 (Professional Fee Estimate, p3) and clause B.3 (Payment Structure, p5) of each agreement.
  • We recommend that descriptions and fees for each block of work, as well as the overall fee and time estimate, be entered in the Fee Schedule for all streams created for these matter types, to ensure that the templates merge correctly.
